These Terms of Use (“Terms”) govern your access to and use of the website located at https://www.aulino.ai and any related pages, features, and content (collectively, the “Site”), including the waitlist sign-up (“Waitlist”).

Important: We are currently in pre-launch. The Site and Waitlist do not constitute an offer to sell products or services. Purchases, subscriptions, or pre-orders (if introduced) will be governed by separate terms.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3) Eligibility and Minors

Website & Waitlist

The Site and Waitlist are intended for adults (e.g., parents, guardians, educators, partners). You must be at least 18 years old to join the Waitlist.

Children’s Data

We do not intend for children to submit personal information through the Site. If you believe a child has provided personal data through the Site, contact us at support@aulino.ai so we can delete it.

Note: If we later offer child-facing product features, child privacy laws (including in the U.S. and EU) may require additional steps and controls. Those will be described in updated terms and privacy notices.

4) The Waitlist (No Guarantee)

By joining the Waitlist, you request to receive updates about Aulino and potential opportunities such as early access, pilots, or invitations.You acknowledge and agree that:Joining the Waitlist is free (unless explicitly stated otherwise in writing at the time of sign-up).

Joining the Waitlist does not guarantee availability, early access, pricing, or a spot in any program.We may invite users at our discretion based on internal criteria (e.g., geography, testing needs, capacity, safety considerations).We may pause, change, or discontinue the Waitlist at any time.

5) Communications and Email Updates

If you submit your email address, you agree that we may send you communications related to the Waitlist and product updates.You can unsubscribe at any time using the link in our emails (or by contacting us).We may use service providers to send emails and manage lists (details in our Privacy Policy).

6) Privacy

Our Privacy Policy explains how we collect and use personal data. The Privacy Policy is incorporated by reference into these Terms.

If there is any conflict between these Terms and the Privacy Policy regarding personal data, the Privacy Policy controls.

7) Intellectual Property

The Site and all content on it—including text, images, designs, logos, icons, videos, audio, and software—are owned by the Operator or its licensors and are protected by intellectual property laws.You may view and use the Site for your personal, non-commercial purposes. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Site or its content, except as permitted by law or with our written permission.

8) User Submissions (Feedback)

If you submit ideas, suggestions, or feedback (“Feedback”), you agree that we may use the Feedback without restriction and without compensation to you. You represent you have the right to provide such Feedback.

9) Prohibited Conduct

You agree not to:

  1. Use the Site in any way that violates applicable laws or regulations.
  2. Interfere with or disrupt the Site, servers, or networks.
  3. Attempt to gain unauthorized access to any systems or data.
  4. Scrape, crawl, or harvest data from the Site (except as permitted by robots.txt and applicable law).
  5. Upload or transmit malware, harmful code, or spam.
  6. Misrepresent your identity or submit false information.

General Disclaimer

The Site is provided on an “as is” and “as available” basis. We make no warranties that the Site will be uninterrupted, error-free, secure, or free from harmful components.

No Medical or Emergency Use

The Site (and any information or concepts described) is for general informational purposes and does not provide medical, psychological, or therapeutic advice. Aulino is not intended to diagnose, treat, cure, or prevent any disease.If you believe you or someone else may be in danger or needs immediate help, contact local emergency services (911 in the U.S., 112 in the EU) or a qualified professional.

AI-Related Notice

If the Site describes or previews AI features, you acknowledge AI outputs may be inaccurate or incomplete and should not be relied upon as professional advice.

12) Limitation of Liability (USA + Germany/EU Compatible)

12.1 For Users in the United States

To the maximum extent permitted by law, the Operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill, arising out of or related to your use of (or inability to use) the Site.

To the maximum extent permitted by law, the Operator’s total liability for any claim arising out of or relating to these Terms or the Site will not exceed USD 100.

Some states do not allow certain limitations, so some of the above may not apply to you.

12.2 For Users in Germany / EU

Nothing in these Terms limits liability where liability cannot be excluded under applicable law. In particular:
  1. We have unlimited liability for damages arising from intent or gross negligence, and for injury to life, body, or health.
  2. In cases of slight negligence, we are liable only for breach of an essential contractual obligation (“cardinal duty”), and such liability is limited to typical, foreseeable damages.

13) Indemnification

If you use the Site for business purposes, you agree to indemnify and hold harmless the Operator from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the Site.

14) Changes to the Site and Terms

We may update the Site and these Terms from time to time. The “Effective Date” above will reflect the latest version.If changes are material, we will take reasonable steps to notify you (e.g., posting a notice on the Site). Your continued use of the Site after changes become effective means you accept the updated Terms.

15) Governing Law and Jurisdiction

15.1 United States

If you reside in the United States, these Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Exclusive venue for disputes shall be the state and federal courts located in California, unless mandatory law provides otherwise.

15.2 Germany / EU

If you reside in Germany or another EU country, these Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection laws of your country of residence remain unaffected.

16) Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

17) Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Operator regarding the Site and Waitlist and supersede any prior agreements on the subject.
