These Terms & Conditions (“Terms”) govern your access to and use of the website https://www.aulino.ai and any related pages, features, and content (collectively, the “Website”), including any waitlist sign-up forms (“Waitlist”).By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.

1) Who We Are

In these Terms, “Aulino,” “we,” “us,” and “our” refer to the Operator.

2) Scope (Pre-Launch / No Sales Yet)

Aulino is currently pre-launch. The Website and Waitlist are provided for informational purposes and to allow interested users to receive updates.

No Offer / No Contract of Sale. Nothing on the Website constitutes a binding offer to sell products or services. We are not currently offering checkout, subscriptions, or paid plans through the Website. If we later introduce sales, pre-orders, or subscriptions, separate terms (e.g., Terms of Sale) may apply.

3) Eligibility and Minors

3.1 Adults Only for the Website & Waitlist

The Website and Waitlist are intended for adults, such as parents, legal guardians, educators, or business partners. You must be at least 18 years old to join the Waitlist.

3.2 Children’s Data on the Website

The Website is not directed to children under 13. Do not submit personal data of a child through the Website. If you believe a child has submitted personal data, contact us at support@aulino.ai and we will take reasonable steps to delete it.

Note: If/when we provide child-facing product features (outside the Website), additional child-safety and child-privacy controls may apply and will be described in updated documentation.

4) The Waitlist (Free / No Guarantee)

By joining the Waitlist, you request to receive updates regarding Aulino, including possible opportunities such as early access, pilots, or invitations.You understand and agree that:
  1. The Waitlist is currently free, unless explicitly stated otherwise at the time of sign-up.
  2. Joining the Waitlist does not guarantee early access, a specific invitation date, a product spot, or any pricing.
  3. We may invite users at our discretion based on internal criteria (e.g., geography, testing needs, safety considerations, and capacity).
  4. We may modify, pause, or discontinue the Waitlist at any time.

5) Communications and Email Updates

If you provide your email address, you agree we may send you:
  1. Waitlist confirmations (if applicable),
  2. Product updates,
  3. Pilot invitations or surveys related to Aulino.
You can unsubscribe at any time using the link in our emails or by contacting us.

6) Privacy

Our Privacy Policy explains how we collect and use personal data. The Privacy Policy is incorporated by reference into these Terms.

If there is any conflict between these Terms and the Privacy Policy regarding personal data, the Privacy Policy controls.

7) Intellectual Property

The Website and all content on it (including text, images, graphics, designs, logos, icons, audio/video, and software) are owned by the Operator or licensed to us and are protected by intellectual property laws.

‍Limited permission. You may access and use the Website for your personal, non-commercial use. You may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, scrape, or create derivative works from the Website or its content, except where permitted by mandatory law.

8) Feedback

If you submit ideas, suggestions, or feedback (“Feedback”), you grant us a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate Feedback for any purpose without compensation, unless prohibited by law. You represent you have the right to provide such Feedback.

11.2 Not Medical Advice / Not a Medical Device

Aulino is not a medical device and the Website does not provide medical, psychological, diagnostic, or therapeutic advice. The Website is for general informational purposes only.

If you believe you or someone else is in danger or needs urgent help, contact local emergency services (911 in the U.S.; 112 in the EU) or a qualified professional.

11.3 AI/Technology Notice

If the Website describes AI features, you acknowledge that AI outputs may be inaccurate, incomplete, or inappropriate in some contexts and should not be relied upon as professional advice.

12) Liability

12.1 For Users in the United States

To the maximum extent permitted by law, Aulino will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill arising out of or related to your use of the Website.

To the maximum extent permitted by law, Aulino’s total liability for any claim arising out of or relating to these Terms or the Website will not exceed USD 100.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

12.2 For Users in Germany / EU

Nothing in these Terms limits liability where liability cannot be excluded under applicable law. In particular:
  1. We have unlimited liability for intent and gross negligence, and for injury to life, body, or health.
  2. In cases of slight negligence, we are liable only for breach of essential contractual obligations (“cardinal duties”), limited to typical and foreseeable damages.

13) Indemnity

If you use the Website for business purposes, you agree to indemnify and hold Aulino harmless from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or misuse of the Website, to the extent permitted by law.

(For consumers in certain jurisdictions, indemnity obligations may be limited by mandatory law.)

14) Changes to the Site and Terms

We may update the Website and these Terms from time to time. The “Effective Date” above reflects the latest version.If we make material changes, we will take reasonable steps to provide notice on the Website. By continuing to use the Website after changes become effective, you agree to the updated Terms.

15) Governing Law and Dispute Resolution

15.1 If You Reside in the United States

These Terms are governed by the laws of the State of: California, excluding conflict-of-laws rules.

Subject to mandatory law, you agree that any disputes will be brought in the state or federal courts located in San Francisco, California, and you consent to personal jurisdiction there.

15.2 If You Reside in Germany / the European Union

These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).Mandatory consumer protection laws and jurisdiction rules of your country of residence remain unaffected.

If you are a consumer in the EU, you may generally bring claims in the courts of your place of residence, and we may have to bring claims against you there.

16) Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.

17) No Waiver

If we do not enforce a provision of these Terms, that does not waive our right to enforce it later.

18) Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and Aulino regarding the Website and Waitlist and supersede prior communications on the subject.
